By engaging with our app/website, you enter into an agreement to adhere to the terms and conditions outlined below, along with our privacy policy, governing the relationship between you and Mobility Services Pvt Ltd (the proud owners of Bus Porter) concerning this platform and the services provided herein.


Should there arise any conflict between the terms stated herein and those of any other document exchanged between us, these terms shall take precedence.


    DEFINITIONS: In the realm of this contract of Carriage between you and us, the following definitions apply:


  • • "We," "us," "our," "Carrier," "Bus Porter," or "Company" denote Go1st Mobility Services Pvt Ltd (the proprietors of Bus Porter), its staff, and its agents involved in transporting or facilitating the transport of consignments or rendering ancillary services on its behalf.
  • • "You," "your," or "consignor" refer to the sender, consignor, consignee, holder of the Consignment Note, recipient, or legal stakeholder in the contents of the Consignment, as applicable.
  • • "Services" encompass the offerings provided by Bus Porter, including:

    o The transportation of goods by Customers for point-to-point or time/usage-based service within and outside city limits, including inter-city travel across India.

  • o Labor hiring for loading/unloading consignments.

    o Any additional services subsequently introduced by Bus Porter.

  • • "Carriage" constitutes all operations and services undertaken by us concerning the Consignment.
  • • "Consignment" signifies any package, parcel, sachet, or freight accepted by us for carriage under our Consignment Note.
  • • "Dangerous Goods" refers to items classified as hazardous according to various transportation regulations.
  • • "Delivery" denotes the handover of the consignment to the consignee or notification of its arrival.
  • • "Prohibited Items" are goods or materials whose carriage is prohibited by Applicable Law.
  • • "Receiver" or "Consignee" indicates the recipient or addressee of the Consignment.
  • • "Applicable Law" encompasses all legal statutes, regulations, guidelines, and directives of India or any other relevant jurisdiction.

USER(S) ELIGIBILITY: A "User(s)" is defined as any individual or entity legally operating in India or elsewhere, utilizing and entitled to use the Services offered by Bus Porter. It is emphasized that our Services are accessible solely to those individuals or entities capable of forming legally binding contracts under the Applicable Law, with individuals needing to be at least 18 years of age.


Bus Porter advises users to adhere to relevant laws while accessing the website. Users are solely responsible for their actions during website use, with Bus Porter retaining the right, at its discretion, to refuse service to anyone, at any time.


User Agreement


This agreement pertains to users, whether they are visitors or registered, free or paid users, accessing the website for any purpose. It extends to any legal entity you may represent under actual or apparent authority. Users are permitted to use this site solely for their personal or internal purposes.


This agreement encompasses all Bus Porter Services, along with any additional terms and conditions applicable to the specific service utilized or accessed by users. In cases of conflict or inconsistency between the provisions herein and those of a particular service, the terms and conditions specific to such services shall prevail.


Amendment to User Agreement


Bus Porter reserves the right to change, modify, amend, or update this agreement at any time, with or without prior notification to users. The amended terms and conditions shall become effective immediately upon posting. Failure to comply with the changes necessitates discontinuation of service usage. Continued use of the Services indicates acceptance of the modified terms and is deemed acceptance of the amended Agreement. Users are also bound by any amendments made to policies or agreements referenced in these Terms of Service.


Intellectual Property Rights


Bus Porter is the rightful owner or lawful licensee of all rights to the website and its content, including design, layout, text, images, graphics, sound, and video. This content is protected under worldwide copyright and other laws. All intellectual property rights in the website and its content shall remain with Bus Porter, its affiliates, or licensors.


The information provided on this website is intended solely for general information purposes, and users accept full responsibility for its use. Bus Porter does not guarantee the accuracy or reliability of any information or advertisements contained within the Services. Users acknowledge that reliance on any content is at their own risk.


Bus Porter reserves the right, without obligation, to make improvements or correct errors in any portion of the Service or the app/website. Unauthorized copying, modification, use, or publication of Bus Porter's trademarks is strictly prohibited.

Termination


While most content and features on the website are freely accessible to visitors, Bus Porter retains the authority to terminate access to specific areas or features of the site at its discretion, with or without notice. Moreover, Bus Porter reserves the universal right to deny access to its Services to particular users, without prior explanation, to safeguard the interests of Bus Porter and other visitors. Additionally, Bus Porter reserves the prerogative to modify access to the website and its features for different users or to introduce new features without prior notice.


Terms & Conditions for Use of Our Service


    The following Terms & Conditions govern customers utilizing the Services provided by the Company for vehicle hiring:


  • • The customer is obligated to pay the agreed fare, parking charges, additional night surcharge (if applicable), and any other fee or levy mandated by the Applicable Law for availing Bus Porter's Services.
  • • The customer acknowledges that the use of the Services is solely at their own risk and that the Company disclaims all representations and warranties, whether express or implied.
  • • The customer must refrain from certain activities while availing the service, including damaging the vehicle or its devices, violating traffic rules, or pressuring the driver to overload the truck.
  • • The Customer agrees to indemnify the Company against any liabilities, losses, or expenses incurred due to their use or proposed use of the Services.

The Company is authorized to use location-based information provided by telecommunication companies to facilitate vehicle bookings. Moreover, the Company may disclose customer particulars to its group companies or government bodies as required by Applicable Law.


The Company reserves the right to terminate vehicle bookings without reason. Users must indemnify Bus Porter for any expenses related to such bookings. Bus Porter's liability for consignment loss or damage is subject to the Carriage by Road Act and Rules.


Users cannot withhold payment for consignment loss and must indemnify Bus Porter for any losses incurred during the period of payment delay. Any complaints regarding the Services or vehicle usage must be communicated to the Company within 24 hours.


The Company is not liable for driver conduct but encourages users to report any complaints. Bus Porter may amend these terms and conditions at any time, with users bound by such amendments upon incorporation into the terms and conditions on the Company's website.


All calls to the Company's call center are recorded for quality and training purposes. By contacting Bus Porter, users consent to receive responses via telephone or email regarding Services queries. Users acknowledge that Bus Porter is not liable for inaccuracies in user-provided data.


Cancellation Policy: Cancellations made 5 minutes after driver allocation will incur a fee of INR. 50/-. Cancelling four bookings in a day after driver allocation will suspend the account for 24 hours.


Toll Charges: Return toll fare will be charged in case of tolls during the trip.


Labour Services


Bus Porter offers Customers the option to utilize Labour Services by toggling the "Include Labour" feature on the review screen of the website/App.


"Labour Services" entail the laborer undertaking the task of loading/unloading consignments of goods from the designated point to the vehicle, or vice versa.


    By opting for Labour Services through the "Include Labour" toggle or availing the service, Customers agree to the following terms and conditions, in addition to those applicable for hiring vehicles:


  • • Customers acknowledge that Labour Service is provided solely for ground floor to ground floor loading/unloading, with a maximum distance of 25 meters between the transport vehicle and the loading/unloading point.
  • • Customers accept that additional charges for Labour Service, as indicated in the Invoice, are payable.
  • • Customers agree to be present during the loading/unloading of the Consignment or appoint an authorized representative in their absence.
  • • Customers acknowledge that Bus Porter shall not be liable for laborer misbehavior during loading/unloading. However, incidents should be reported to the Company for necessary action. Confidentiality

Users are prohibited from disclosing any information received under the service contract with Bus Porter to third parties. Access to Bus Porter's business-related information must be kept confidential, with users liable to indemnify Bus Porter for any loss of business or reputation due to their actions.

Disclaimer

All vehicles registered with the Company are tracked for security reasons using mobile technology only. The Company neither owns vehicles nor employs drivers or laborers directly. Vehicles, drivers, and laborers are provided by third parties, and the Company disclaims liability in respect to them.

The Company reserves the right to use customer contact information for its marketing purposes and may send regular SMS updates to registered mobile numbers.

    Ace Plus Terms and Conditions

  • • Only ground floor to ground floor loading/unloading is permitted.
  • • The distance between Bus Porter truck and loading/unloading point should not exceed 25 feet (8 meters).
  • • Maximum weight per box allowed is 25 kg, with up to 30 such boxes/cartons permitted.
  • • Labour charges will be automatically added to the invoice.

Your Acceptance of Our Terms and Conditions


By entrusting us with your consignment, you accept the terms and conditions outlined in the consignment note, contract of carriage, or contract for other services. These terms apply to anyone with an interest in the consignment or services, including our employees, directors, and agents. Only authorized officers may agree to variations in writing. Instructions conflicting with our terms and conditions are not binding unless agreed to by one of our authorized officers in writing.


    Your Responsibilities
  • • You warrant, undertake, and guarantee to us that:
  • • The contents of the consignment, including weight and quantity, are accurately described on our consignment note, with all necessary documents enclosed.
  • • The consignment does not contain Prohibited Items or violate any applicable regulations. You agree to provide any required Dangerous Goods declaration in accordance with the law.
  • • All information provided regarding the Consignment is true and correct. You acknowledge that false statements may result in civil or criminal penalties, and you indemnify us against any claims arising from such misinformation.
  • • We are authorized to deliver the goods to the address specified on the Consignment Note. Delivery confirmation will be sent via SMS/email, with no response within 24 hours considered confirmation of delivery.
  • • You have declared the correct weight of the consignment and will provide any necessary equipment for loading/unloading.
  • • If you request charging the receiver or a third party and they fail to pay, you agree to settle our invoice within 7 days, including an administration fee.
  • • You have complied with Applicable Law.
  • • You acknowledge that the Services are not suitable for transporting valuables. Any loss or damage to valuable items during transportation is at your own risk, and we disclaim liability.
  • • If the consignment's value exceeds INR 25,000, you must insure it with a General Insurance company in India. Failure to do so or incorrect declaration makes transportation entirely at your risk, with us disclaiming liability.
  • • You indemnify us against any liabilities, costs, or damages incurred due to your breach of these obligations, even if we inadvertently accept a non-compliant consignment.
  • • You certify the accuracy of all statements and information provided regarding the consignment. False statements may result in civil or criminal penalties, and you agree to indemnify us for any resulting claims or costs.
  • • You acknowledge that the use of our Services is at your own risk, with all representations and warranties excluded to the fullest extent permitted by law.
  • • You agree that circumstances beyond our control, including acts of nature, force majeure, transportation disruptions, and criminal acts of third parties, may affect the transportation process. You indemnify us against any claims arising from such events.

In summary, you understand and accept that complying with these obligations is crucial for the safe and efficient transportation of your consignment.

    Handling Dangerous Goods

  • • Dangerous Goods Policy:
  • • We refrain from transporting or handling goods deemed Dangerous Goods, as per relevant regulations and guidelines.
  • • Exceptions may be made in select locations for approved customers, subject to compliance with regulations and our requirements.
  • • Prohibited Items:
  • • We do not accept consignments containing prohibited items.
  • • Declaration Responsibility:
  • • Consignments are accepted based on your declaration of type and value ("said to contain" basis). We disclaim responsibility for declaration accuracy and indemnify ourselves from related claims. Rejected Consignments If a receiver rejects delivery, we'll consult you on the appropriate action. You agree to cover any associated costs and charges.

Termination If you terminate an agreement with Bus Porter regarding a consignment, you're liable for all fees incurred.

Third-Party Claims You agree not to permit any third-party claims against us arising from carriage, even in cases of our negligence. You indemnify us against any related costs.

GST GST applies to invoices prospectively, with no retrospective revisions for delayed registration information. Reverse charge mechanism taxes are payable by the service recipient. Governing Law These terms are governed by Indian law, with disputes to be settled in Bhopal courts.
